Stuart's reply to the PCA

Wednesday, 8 Oct 2003

Thank you for your reply. There are several glaring issues and inconsistencies here that need to be addressed:

  1. The damage to my car; this was pointed out several times to both officers in response to their accusation that I had left my car unlocked, and the fact that the driver's door handle was damaged is acknowledged by PS Millican. I told him my car had bad been broken into, but he ignored me. His statement that I did not make a complaint at the time is totally false. It should be noted that anyone observing the incident from the restaurant would be 'blind sided' and unable to see the driver's side door where the damage occurred.
  2. When the police arrived at the scene the wheel clamper was in physical possession of my firearm without my permission or a firearms certificate, itself a serious criminal offence. He admitted entering my vehicle, having no lawful authority to do so, and should have been arrested for this. The police officers at the scene ignored the evidence of their own eyes.
  3. Why has the matter of my expired Explosives Certificate been raised? I no longer required this item and chose not to renew it.
  4. The firearms officer is not named, yet on his advice my home was raided and property seized - this after PS Wardrop had found there were insufficient grounds for my arrest and detention. As my property is still being held, I believe I have grounds for launching a separate complaint against this individual.

In conclusion: my arrest was not a "combination of unfortunate circumstances" but as result of sloppy, inefficient police work and a bias against lawful firearms holders in Avon & Somerset. "Inspector Palmer says she decided whether or not you would be arrested. In making her decision she had concerns for public safety arising both from your behaviour and from information she had received regarding your criminal convictions, especially a bomb hoax in America in 1998. The Inspector says you were arrested for not holding a valid licence." My behaviour on the day was to make a 999 call to police to prevent an unauthorised person taking possession of my firearm. How is that a threat to public safety? If indeed there were such a threat, then that would alone be grounds for my arrest, yet the reason I was arrested (according to Insp. Palmer) is that my licence was allegedly 'invalid' - presumably due to 20 year old spent convictions and a false allegation against me in America that was proven unfounded in a US Court of law five years ago.

I am disgusted at the lengths Avon & Somerset went to in an attempt to convict me of an offence while another individual who by his own admission entered my car unlawfully and was in possession my firearm when the police arrived on the scene was allowed to walk free.

I look forward to reading your comments.
